PORA ANTICRISIS PLAN OF ACTIONS

 

Term of realization – 4 months (till the end of 2005)

Start of realization – September 1, 2005 

 

 

1.         To avoid the constitutional crisis

 

To announce a clear and joint position of authorities towards the problems of constitutional reform and to proclaim Ukraine’s state structure after reform’s realization till the Day of Ukraine’s Independence

     

2.         To establish order in the state administration

 

Until the end of September 2005 to balance according to the legal acts, administrative functions of the President of Ukraine and the Cabinet of Ministers of Ukraine and to adapt according the constitution of Ukraine functions of others departments of state authority (especially Secretariat Office of the President of Ukraine).

To reform the structure of the government of Ukraine, to incorporate the unified system of evaluation of the work by state authority organs, to revise the appointment of ministers and staff policy of state organs.

Until the end of September 2005  - to create effective integrated system of  monitoring and control of the execution of orders, regulations and  instructions by the President of Ukraine, Prime Minister of Ukraine, and  by central organs of state authority. To create a special state institution that will carry out such monitoring of all central organs of state authority and actively involve civil society to such an activity.

 

3.         To create honest and effective power

 

Until the end of 2005 - to reform according to EU standards the system of adopting management decisions, to clearly define the functions and competence of state organs and their internal structures, to implement the system of electronic governance, and to guarantee on judicial level the adoption of government laws already at the stage of their development. To adopt a new law of Ukraine ‘On State Service’.

 

To accomplish an immediate reform of staff appointments in the public service on the basis of  independent professional testing, and to conduct until the end of current year the reappointment of state officials of higher and middle rank on its basis. To develop and implement a unified procedure of appointment of state officials with the help of qualified testing on the basis of a separate state specialized institution.

 

4.         To guarantee the property rights, to return stolen to people

 

Before the middle of September  - to officially and publicly announce about exclusively court mechanisms of returning unlawfully privatized property to the state property and to officially  decline reprivatization and any other uncivilized mechanisms of property return to state ownership which are not inherent to market economy and democratic country.

 

Until the end of this year – to bring to the court all cases connected with the return of all unlawfully privatized and stolen state property to the state, and to provide this process to be of high quality and active support by all adequate organs of state power.

 

5.      To establish rule of law in Ukraine

To complete the elaboration of 2-year plan of the radical court reform by the end of October 2005 and to start its realization at the beginning of 2006. To ensure the complete independence and self-governance of the juridical power branch. To establish the strict mechanisms of public control on the activities of judges and to determine the severe liability for corruption in the court system.

To work out till the end of September 2005 and to adopt the yearly intersectional Anticorruption Plan of Actions that will encompass unification of the activities of public service, providing its complete transparency and accountability, working out clear procedures of adopting state resolutions, implementing the electronic government system in all the state and local authorities, preventing the consumers of state services from direct contacts with state officials, etc. To implement the efficient system of control on implementation of such plan of actions. To legalize the mechanisms of involving citizens and NGOs to the process of public administration based on the principles of partnership and common participation.  

 

6.     To carry out the clearing of power, to punish the criminals

 To accomplish the 2nd wave of clearing the state authorities from corrupt persons, including the representatives of new power. To immediately dismiss the representatives or owners of business structures. To conduct the personal analysis of activities of the high-rank state officials, including ministers and heads of the oblast state administrations. To finish the process of firing the corrupt and inefficient bureaucrats representing the ousted regime on the central and local level.

To complete by the end of the year investigation and to detain all the criminals that while occupying the high state positions committed crimes against Ukrainian people, called for split and federalization of the country and  to anti-constitutional actions, and today sabotage in the organs of state power. To conduct the mandatory personal investigations of the activities of the most odious representatives of the old regime – Kuchma, Medvedchuk, Kivalov and others included in PORA “black lists”.   

 

7.      To provide conditions for economic reforms and development

 To launch a program of involvement and support of investments, improvement of the image of Ukraine for investors abroad before October 2004.  To guarantee the favorable conditions for foreign investments and their protection with a separate legislative act.  To ensure the immediate accession of Ukraine to the World Trade Organization and to abandon the projects on creation of a common custom union and supra-state organs within the framework of the SES (Single Economic Space).

To study the possibilities of introducing amnesty of capital gained in a legitimate, not criminal way, by the end of the year. Such an amnesty can’t be spread over the property that is subject of the court claims filed by the state till the end 2005.  

To immediately weaken the state influence on the management of economics, to work out the policy of reducing taxes and system program of support of small and middle business.

 

Upon accomplishment of this Anticrisis Plan of Actions PORA proposes to start the implementation of the most actual reforms in the strategic development directions of Ukraine, namely:

- court and justice reform;

- tax reform;

- administrative reform;

- educational reform;

- realization of the European Integration strategy;

- reform of the legal regulation of the media sector and creation of the public television;

- reform of the local self-government;

- implementation of the system program of development of the image of Ukraine abroad.

 

CHARTER

CHARTER OF MAIDAN VALUES

The peaceful, democratic and at the same time extremely stylish and beautiful Orange revolution did not end up during the days of Presidential elections. Free and thoughtful choice was important, first, but far not the last step in the program of democratic changes enabled by the sufferings by millions of Ukrainians.

Orange revolution was not a choice of personalities, whom the power was delegated. It was a choice of values on which the New Ukraine was to be built.  Millions went out to the streets to stand up not for their mercantile interests, but for the high ideals of Freedom, Democracy, Morality, Justice, and Citizens’ Dignity. The historic choice of Ukrainian nation proves that the rebirth of Ukraine can be achieved first of all by adhering to the values that were expressed in the slogans of Maidan:

Freedom ‘FREEDOM CANNOT BE STOPPED!’

Aspiration of citizens to self-realization and self-assertion, to reaching basic human rights may not be limited by any brutal force. The citizens are allowed everything that is not forbidden by the law.

The use of force, manipulations, intimidation, violations of law and disrespect of moral norms will not save any government from failure. Because such a power will never be supported by its people.

Democracy “TOGETHER WE ARE MANY! WE CANNOT BE OVERCOME!”

The people’s will is a source of legitimacy and efficiency of the government’s actions. In case of brutal disrespect of peoples’ will, people have a right to protest. The joint collective action by self-organized citizens, based on the peaceful and non-violent struggle for their rights, cannot be won by the cliques of the usurpers of power. Unification of the efforts of citizens and organizations into the joint political civic platform of cooperation is the guarantee of effective democratic control of those in power and prevention from the possible reemergence of an authoritarian regime.

Unity ‘EAST AND WEST – TOGETHER!’

Ukraine is a united country, although its citizens are distinguished through cultural, linguistic, religious, regional and ethnical diversity. The residents of Ukraine are UKRAINIANS, CITIZENS OF ONE STATE notwithstanding their political views, cultural orientations and regional identities. All those who incite to regional (religious, linguistic, ethnic, etc.) split should be condemned by the citizens and prosecuted by law.

Rule of Law ‘CRIMINALS – TO JAIL, PROTECTION TO HONEST!’

All political criminals, including the organizers of election fraud, must incur the deserved and irrevocable punishment. The society and government must go through the period of clearance from the previous experience of abandoning the law. Only the genuine clarification will end with a real affirmation of the rule of law as a really functioning and the only possible principle of justice, instead of its manipulation to satisfy the private interests of a few.

The facts of stealing of state property and finances have to find the reflection in the court sentences. Criminals may not remain in the power, and the system of governance shouldn’t create new criminals. The government is supposed to act only within its functions and in compliance with the Law.

Europeanism ‘EUROPEAN UKRAINE’

Ukraine belongs to the European continent not only in the geographical sense. It is truly European civilization, and even more, it carries a seed of the future Europe, a valuable impulse for the renewing of democracy.

Nowadays Ukraine has to assert its European identity, become an integral participant of social, political, and economical processes in Europe. Institutionally this is measured by attaining the membership and active participation in the leading integrative communities at the European and Euro-Atlantic area. This is a way to satisfy the national interests of Ukraine in the strategic perspective.   

Action ‘WE ARE GOING!’

The control over adherence to the Maidan values is overtaken by the new generation of Ukrainians, whose outlook has been formed in the era of Independence. The generation, which gives all its hopes to self-realization with irrevocability of democratic changes in Ukraine.

The Maidan values can only be really settled through the active citizens’ participation in the political and civic life.

IT IS TIME TO LIVE AND WORK FOR THE COMMON GOAL!
